German Free Movement Act: Brexit and Access to Social Benefits
Just in time before the expiration of the transitional period on 31 December 2020, the German Bundestag is about to adopt the domestic legislation on technical guidance on the application of the Withdrawal Agreement. Daniel Thym was invited to express his views on the legislative project as an expert in the Home Affairs Committee. His written statements and the oral intervention in parliament (both in German) discuss the effects of Brexit and other important aspects of the bill, such as enhanced residence rights for family members and controversial domestic practices when the social courts ‘fictionally’ assess the availability of residence rights the immigration authorities had not accepted.
